Terms of Use
Last updated: September 25, 2026
1. Agreement to Terms
By downloading, installing, or using NimblePaste, you agree to these Terms of Use. For an App Store download, these Terms supplement Apple’s Standard Licensed Application End User License Agreement and the Apple Media Services Terms and Conditions. If you do not agree, do not download or use NimblePaste. Where these Terms conflict with mandatory consumer rights or Apple’s applicable terms, those rights or terms control.
2. License Grant
Subject to these Terms and the applicable Apple Usage Rules, NimblePaste grants you a personal, non-exclusive, non-transferable license to install and use the application on Apple-branded macOS devices that you own or control. This license ends if you materially breach these Terms or stop using the application. Nothing here transfers ownership of NimblePaste or its intellectual property to you.
3. Acceptable Use
You may use NimblePaste only for lawful personal or business purposes. You agree not to:
- Decompile, reverse-engineer, disassemble, or attempt to derive the source code, except as permitted by applicable law or the license terms for included open-source components.
- Distribute, sublicense, lease, rent, or make NimblePaste available for simultaneous use by unauthorized third parties.
- Use NimblePaste to violate another person’s intellectual-property, privacy, security, or other legal rights.
- Use NimblePaste to capture or handle another person’s information without the authorization required by applicable law.
4. Local Data, Backups & Responsibility
NimblePaste is a local clipboard utility. It may store clipboard content, file references, source-app metadata, Boards, tags, Queue items, and backups on your Mac. You are responsible for reviewing captured content, configuring exclusions and retention, protecting your Mac and exported backup files, and deciding where backups are stored or shared. NimblePaste is not a substitute for a separate backup system and does not guarantee that every clipboard item will be captured, retained, or recoverable.
5. Intellectual Property
NimblePaste, including its design, logos, icons, interface layouts, transformations, and underlying code, is protected by copyright, trademark, and other intellectual-property laws. All rights not expressly granted in these Terms are reserved by the publisher. Third-party components remain subject to their own license terms.
6. Support, Warranties & Consumer Rights
The publisher, not Apple, is responsible for providing maintenance and support for NimblePaste, except where applicable law says otherwise. For App Store purchases, Apple may provide a refund under its applicable terms and policies; contact Apple for purchase or refund requests where appropriate.
To the maximum extent permitted by applicable law:
NimblePaste is provided on an "AS IS" and "AS AVAILABLE" basis, without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the application will be uninterrupted, error-free, secure, or that it will preserve every clipboard item. Nothing in these Terms limits a warranty or consumer right that cannot legally be limited or excluded.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the publisher and its contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, business, profits, or use, arising from or related to NimblePaste. This limitation does not exclude or limit liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits that limitation.
To the maximum extent permitted by applicable law, the publisher’s total cumulative liability arising out of or related to these Terms or NimblePaste shall not exceed the greater of (a) the amount actually paid by you for NimblePaste during the twelve (12) months immediately preceding the claim or (b) fifty U.S. dollars (US$50) if NimblePaste was provided at no cost. This cap does not apply to liability that cannot legally be limited or excluded.
8. User Indemnification
You agree to promptly notify the publisher and, to the extent permitted by applicable law, defend, indemnify, and hold harmless the publisher against third-party claims, liabilities, losses, and reasonable legal expenses arising out of your unlawful use of NimblePaste or your material breach of these Terms. The publisher may control the defense and settlement of the claim, and you may not settle a claim in a way that admits fault or imposes an obligation on the publisher without the publisher’s prior written consent. This indemnity does not apply to the extent any claim results from the publisher’s negligence, breach of these Terms, willful misconduct, or unauthorized data handling.
9. Changes and Termination
We may update these Terms when the application or its services change. We will post the revised Terms with a new revision date. For material changes, we will provide additional notice where appropriate. Your continued use after the revised Terms take effect means you accept them. You may end this agreement at any time by stopping use of NimblePaste and deleting it and any copies or backups you control.
10. Apple as a Third-Party Beneficiary
For applications obtained through the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you where applicable. Apple is not responsible for maintenance, support, or claims relating to NimblePaste except as required by its applicable terms or law.
11. Governing Law & Dispute Resolution
To the maximum extent permitted by applicable law, these Terms and your use of NimblePaste are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Except where prohibited by mandatory local consumer protection laws that grant you the right to resolve disputes in your local jurisdiction, any legal action or proceeding arising out of or related to these Terms or NimblePaste shall be brought exclusively in the California state courts located in Contra Costa County, California, or the United States District Court for the Northern District of California, and each party consents to the personal jurisdiction thereof.
12. Severability & Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and the publisher regarding NimblePaste, supplementing Apple’s standard terms where applicable.
